Workers’ Compensation
Colorado Workers’ Comp Attorney - Denver On-the Job Accident Lawyer
Workers’ compensation was enacted by the states in order to ensure that injured workers are provided with medical treatment and lost wages caused by workplace accidents. The system was designed so you do not have to have a Colorado workers comp attorney to represent you in a workers’ compensation matter. But since the claim process is complex, it is recommended that you have an attorney. Attorney Jeffers is exceptionally qualified since she worked with Aetna Insurance as a claims adjuster. If your claim was denied or if you were wrongfully discharged for filing a claim you would be well advised to contact a Colorado workers’ comp lawyer.

Important Facts about Workers’ Compensation
-
Workers’ compensation is a no-fault system. You may be eligible for benefits even if you, a co-worker or your employer are at fault for the injury.
-
In the event an employee is killed because of a work-related accident or illness, workers’ comp laws provide benefits for the dependents of the worker.
-
Temporary and permanent partial disability benefits are limited by statutory caps.
-
According to the law of the State of Colorado, you cannot pursue a worker’s compensation claim or sue your employer and its liability insurance company in district or federal court.
-
If you dispute any portion of your claim which the insurance company denied, you have a right to a hearing before an administrative law judge. You do not have a right to a jury trial.
-
Although an injured worker can usually obtain a hearing before an administrative law judge within three months, it can take over six months from the time an Application for Hearing is filed.
-
If the insurance company files a General Admission in your case, and your claim is compensable under workers’ compensation laws, you will be entitled to medical benefits, including medical treatment, prescriptions, certain equipment, and mileage.
-
Under certain conditions, you may be entitled to temporary partial disability and temporary total benefits to compensate you for lost wages.
-
When your medical condition stabilizes, you have achieved maximum medical improvement. At that point, you may be entitled to permanent partial and/or permanent total disability benefits.
-
Once you receive your workers’ compensation benefits, attorney (and former claims adjuster) Mary Jeffers will assist with monitoring your benefits to ensure that you are receiving the correct amount of compensation under the law.
